Jury Selection and Questionnaires

We will help formulate a voir dire questionnaire and attend jury selection with our clients. We use a mixture of intense questioning, keen observation, and years of experience to deselect people we think would hurt the case.

We look at their backgrounds, life experiences, and opinions that would make potential jurors less receptive to the case. We even review public activity on various social media accounts to discover affiliations with different groups, websites, Facebook pages, and their likes and dislikes.

Trial Support/Courtroom Presence

PRESENCE in the courtroom is what separates SPLASH – The Trial Concierge from the rest. Having the jury monitored closely from voir dire to verdict is invaluable as many times certain strategies and/or themes need to be adapted according to the evidence produced. Excessively lengthy trials will have special arrangements to ensure the attorney is supported throughout the plaintiff’s case and at closing.

Arbitration Graphics

Visual communication and persuasion is just as important for cases decided by arbitration as those decided by jury. However, the specific choices and strategies that will be most effective can vary based on the intended audience.

Litigation Graphics

A picture, animation, or graph says more than a thousand words to jurors.  Many post-juror interviews center around the one visual that “simplified” the case to them and resulted in their opinion.  This is still a tough area for many attorneys heading into the courtroom because it takes planning and forethought early in the case.  The best demonstratives are those that help solidify the essential facts of the case and showcase opinions in depositions.

Splash will immediately help to identify the best elements and strategies in your case and how to best present them visually.  We will work with animators, graphic artists, and your experts to develop these aids to maximize their effectiveness and persuasiveness.

Deposition Preparation

Preparing and presenting a client or expert for a deposition can be a humbling experience.  The key is to put forth the theme of your case and to learn the strengths and weaknesses of the other side’s position.  Strategy must be incorporated when deciding what elements should be emphasized and what should be held for the courtroom.

The deposition of a client or expert is a crucial foundation for the case.  It serves as the basis for presenting your case to the jury, setting up an impeachment, and discovering the pearls on which your case will thrive in front of the jury. We will prepare your witness in how to present themselves, expect what is coming from the other side, and deliver their position with confidence.  We never forget that it is as important to prep and arm the attorney for the deposition as it is the deponent.

Focus Groups and Mock Jury Support

The best way to know what a jury is likely to think about your case’s themes, arguments, and strategies is through focus groups and mock juries. No matter how long you’ve been in practice, focus groups can still uncover unanticipated obstacles and help you refine your case. 

Focus groups are extremely flexible and allow you to address a number of issues in a single day: improve your overall case strategy, develop case themes, assess case strength, uncover implicit assumptions, test people’s reactions to different themes, determine the key issues, and more. 

Witness Preparation

DEMEANOR is everything in the courtroom. The strongest messages of the case can be lost due to arrogance, anger, or absence of the ability to make the jury feel the emotion. The witness stand is intimidating for most who are called to sit there.

This has been one of Splash’s greatest accolades by attorneys. Proper trial preparation cannot be completed with just one meeting the night before testimony.  Client prep should start weeks before the trial. Many small prep sessions should take place once the trial begins to evaluate how their prepared testimony may need to be tweaked from events occurring during the trial. It is vital that the attorney rely on this help from the trial consultant.

Courtroom and Mediation Presentations

Splash has provided over 350 mediation presentations, openings, and closings over her career in the legal venue.  Many testimonials speak to her unique abilities to present the case in the most positive, compelling way via PowerPoint. Voir Dire Coaching

Voir dire is not only about choosing jurors. It is your best opportunity to lay out your case themes. You can gain valuable feedback about how the jurors feel about your case. 

Splash provides individual hands-on voir dire coaching in how to develop strong voir dire questions that discover the critical details of potential jurors, as well as how to present demonstrative aids and adjust for time-sensitive voir dires. You only have one chance to make a first impression on the jury—make sure it’s a good one. 

Case Analysis

Although more than 90 percent of civil lawsuits are settled before they go to trial, it is important to prepare a case as if would go all the way to the trial. A clearly defined litigation strategy, that is designed to achieve the client’s objectives, will guide the preparation and presentation of any case.

Specialized Legal Nurse Consulting

Legal nurse consultants (LNCs) are specialized nurses who provide medical expertise to people or groups who handle legal issues—such as lawyers, court officers, lawmakers, insurance companies, or government agencies. 

Splash Abbott has decades of experience as a trauma nurse and nurse administrator and is one of the only female nurse trial consultants in practice today. She can help with interpreting medical records, background medical research, drafting legal documents with medically sound information, testifying in court as an expert witness, and more.
